Warranty Terms of Service

Application

  1. This Warranty applies to the steel fence infill sheeting products range (products) designed and manufactured by Hale Industries Pty Ltd ACN 641 037 247 (Hale) and supplied by Hale in the course of business.
  1. This Warranty covers the Material in the products and is subject to the limitations and exclusions below.

 

Assurances

  1. You can be assured that Hale products are:
  • made from quality pre-painted high-tensile steel.
  • compliance-tested against Australian standards by a NATA-accredited engineering laboratory for tensile properties, coating mass, base level thickness, coating adhesion bend and base metal chemical composition.
  • manufactured for consistency and inspected for quality prior to despatch.
  • supplied under a 10-year warranty against corrosion perforation in natural conditions.
  • protected under Australian design registrations.

 

Warranties

  1. Subject to this Warranty, all products are supplied with the following warranties.
  • Repair or replace any part of a product which fails due to a Material Defect during the Warranty Period; and
  • Re-paint any defect to the surface of a product that occurs due to a Material Defect during the Warranty Period.

 

Consumers

  1. If you acquired the products as a consumer (as defined in section 3 of the Australian Consumer Law), the products come with non-excludable guarantees, which entitle you:
  • for a major failure, to replacement or refund and compensation for any other reasonably foreseeable loss or damage; and
  • for other failures, where the products are not of acceptable quality, to have the goods repaired or replaced.
  1. The benefits you receive under this Warranty are additional to other rights and remedies you may have under law in relation to the products.

 

Exclusions

  1. The following exclusions apply where the defect or damage was caused by, due to, contributed to, or otherwise attributable to or by any:
  • exposure to or contact with any material or agent with corrosive or harmful properties other than the Elements;
  • corrosion of components other than the Materials, including framing, screws, fasteners, bolts, rivets, brackets, posts, rails, end-caps and accessories;
  • highly corrosive environments including coastal, marine and industrial (unless otherwise stated under Hale’s instructions);
  • fair wear and tear, and natural weathering, including natural reduction of gloss or finish colour or tone;
  • fault of any person in damaging, or interfering or tampering with, the products (whether or not intentionally), or in failing to install or maintain the products in accordance with Hale’s instructions;
  • fault arising in the design, manufacture, transport, handling, storage, assembly or installation of the products; and
  • extreme weather including earthquakes, hurricanes, tornadoes, cyclones, typhoons, gales, lightning, severe hail, fires, floods, blizzards, and any other extreme or unnatural conditions.
  1. This Warranty does not cover nor extend to:
  • labour costs associated with the repair of the products;
  • costs of removal, return, re-delivery and re-installation of repaired or replaced products;
  • personal injury, property damage, consequential or indirect loss, including but not limited to loss of profits and business interruption;
  • your costs and expenses relating to making a claim under this Warranty; and
  • costs of replacement or repair of non-Material components including without limitation posts, rails, brackets and accessories.
  1. This Warranty will be voided by failure to install or maintain the products in accordance with Hale’s instructions.
  1. Hale’s liability under this Warranty shall be limited to the extent permitted by law, (at Hale’s option) to replacing the defective product component with the same or equivalent Material, or paying the cost of the same.

 

Definitions

  1. In this warranty, capitalised words have the following meanings.
  • Elements means air, rain, hail, snow, and sunlight.
  • Installation Date means the date at which the products are installed at the customer’s nominated site.
  • Material means the materials in the sheeting and layer components of the finished products, comprising steel base of at least 0.35mm thickness, alumozinc layer, chromed layer, basic layer and transparent polyethylene layer.
  • Material Defect means a defect in the Material due to exposure to the Elements that results in corrosion to perforation of the products during the Warranty Period.
  • Warranty means the terms and conditions set out in this document.
  • Warranty Period means 10 years from the Installation Date.

 

Warranty Claims

  1. Any claim under this Warranty must be notified to Hale within 30 days after you became aware of the defect. For claims lodged outside that period, Hale may in its absolute discretion reject the claim and have no liability under this Warranty. All claims must be accompanied by sufficient evidence as to the nature and cause of the defect.
